Injuries or Death caused by Motorcycle Accidents

Motorcycle accidents and injuries can be caused by a number of factors, including defective roadway designs, poor weather conditions, product defects (including defective tires or defective helmets), and the recklessness or negligence of other drivers. Because motorcycles do not offer the physical protection that cars do, motorcycle riders are much more vulnerable to serious injuries, such as traumatic brain injuries, broken limbs, road rash, and other serious conditions, or even death. In Colorado and throughout the country, motorcycle laws are in place to prevent such injuries and deaths. Unfortunately, thousands of motorcycle accidents continue to occur each year. A motorcycle accident attorney at The Babich Law Firm can help victims throughout the United States obtain compensation for their injuries, damaged or lost property, medical bills, lost wages, pain and suffering, and other damages.

Paying For Medical Expenses

A motorcycle accident can change your life or a loved one’s life. For example, if you are seriously injured, you may have to take time off from work, and you may have unpaid medical and/or hospital bills. After being injured in a motorcycle accident, the first question many people want answered is "who will pay for my medical expenses?"

Keep in mind that because a personal injury claim can take months, or even years, to resolve, you cannot rely on anticipated settlement proceeds or a jury award to pay for your immediate health care needs. If you have no health insurance available to help cover your medical expenses, the attorneys at The Babich Law Firm will work with health care professionals in your area to get you the medical care you need. Often, a health care provider will agree to treat you if we agree to pay them back after you receive a settlement or award. The attorneys at The Babich Law Firm can help get you the medical care and attention you need while your claim is being investigated, evaluated, and negotiated.

If you are injured in a motorcycle accident, or your loved one suffers serious injury or death in a motorcycle accident, contact an attorney at Babich Law in Denver, Colorado. Our team of motorcycle accident and wrongful death attorneys can evaluate your case and help you understand your rights. We will help you get the money you deserve for lost wages, medical and surgical bills, pain and suffering, loss of a loved one, or other damages. We can also assist with complex truck accident, auto accident, aviation accident, defective products, insurance bad faith, medical malpractice, slip and falls, wrongful death, and other personal injury claims.

Automobile Insurance Coverage

Colorado law requires every owner of an automobile in the State of Colorado to have two types of mandatory insurance:

  • Property damage liability coverage – this coverage provides compensation to another person for damage to their automobile caused by the at-fault driver.
  • Bodily injury liability coverage – this coverage provides compensation to another person for bodily injuries sustained in a motor vehicle collision. The State of Colorado requires that every owner of an automobile have at least $25,000.00 in bodily injury liability insurance coverage.

It is very important to have motorcycle accident attorneys examine all of the potential insurance policies that may provide coverage to you as a result of your accident, as you may be able to collect compensation from more than one insurance policy, including your own insurance policy. See section on Uninsured/Underinsured Motorist coverage. At The Babich Law Firm, our attorneys act immediately for our clients to determine what kind and how much insurance coverage is available to you.

Establishing a Personal Injury Claim

To establish a claim for your personal injuries related to a motorcycle accident, the following three requirements must be met:

  • you must prove that you have suffered injuries;
  • you must prove that your injuries were caused by the auto accident, and not some other accident or incident; and
  • you must prove that the auto accident was not caused by you. Under Colorado law, if you are found to be more than 50% at fault for the accident, then you are not entitled to a jury verdict if the case goes to trial. Therefore, early and proper investigation is critical to proving that you are not 50% or more at fault.

If The Babich Law Firm accepts your case, we will investigate your claim and obtain the evidence needed to prove your claim. This may involve interviewing witnesses, reviewing documents, researching the law, investigating the scene of the incident, and consulting with doctors or other experts.

What Compensation You Are Entitled To Recover

You are entitled to recover the following types of damages or losses from the person who caused the accident (the at-fault driver) and/or their insurance company:

  • economic damages (including past and future medical expenses, funeral expenses, past and future lost wages, impairment of earning capacity, and other out-of-pocket expenses such as prescription drug costs);
  • non-economic damages (including inconvenience, loss of quality of life, emotional distress, pain and suffering); and
  • physical impairment and disfigurement.
